The 25% residential rent increase limit is set to expire on 1 July 2024. Regarding the new rent increase rates and the legal situation for tenants and landlords, Attorney Ileri said:
“As of July 1, the 25% rent increase limit was lifted, but in any case, workplaces are not included in this limit. For residential properties, if the 12-month average Consumer Price Index is stated as a condition for increase in the contract to be renewed after July 1, the new period rent will be determined based on it. An important detail is that the WPI-CPI average is stated in the lease agreement. If the contract states that the rent will be increased according to the WPI-CPI average, this clause will be invalid. Since these averages generally exceed the CPI of our country, this article will be invalid. “There is no legal impediment for tenants to increase the Consumer Price Index (CPI) rate in accordance with the mandatory provisions.”
Would a second rent increase be possible after July 1st?
Lawyer Aslikan Özgür Ileli finally issued an important warning, saying, “In residential lease agreements, which are generally concluded for one year, an increase can only be requested after this period has passed. For example; ‘In a residential lease agreement for the renewal of the lease period in May 2024, the rent increase has been made as 25%, and it would be a violation of the law and procedures to increase it again after July 1st, and the new lease period in May 2025 must be extended and awaited increase,'” he said.
