Polat K., a 19-year-old tile worker from Aksaray, went to the Regional Gendarmerie Headquarters on April 16 to visit a friend who had been in a traffic accident.
He then suddenly found himself stranded at the exit of a police station and, as there were no toilets nearby, he urinated on the wall surrounding his parked vehicle.
Private First Class Furkan A., who witnessed the incident, immediately reported the situation to his superior officer.
The person on duty, Sergeant Ramazan G., immediately reported the situation to the Prosecutor’s Office, and the police arrested Sergeant Polat K., who, following the Prosecutor’s instructions, urinated on the wall of the Gendarmerie Headquarters building.
“I’m very sorry, but there were no other columns available.”
Polat K., who was questioned at the police station, said in a statement: “I found out about the accusations against me at the police station. I would like to make a statement without the assistance of a lawyer. I work as a tile master. On the day of the incident, I went to the Regional Gendarmerie Headquarters to visit a friend of his who had been in a traffic accident. I ended up stuck at the entrance to the Gendarmerie Headquarters guardhouse. I looked around but couldn’t find anywhere nearby where I could go to the toilet. I live in a village, so I don’t know much about the center. At that moment, I was stuck in my situation, so I urinated on the wall of the Regional Gendarmerie Station. “I am very sorry about this incident. That’s all I want to say,” he said.
“I saw him pushing with his back to us.”
The testimony of Private First Class Furkan A., who was on guard at the entrance to the Second Command Post, was also accepted as a witness.
The serving private said in a statement: “I serve as a private at the Aksaray Provincial Gendarmerie Command. On the day of the incident, when I was leaving the gate of the guardhouse to follow up with my assigned commander, Ramazan G., I saw a person named Polat K. urinating against the wall of the Regional Gendarmerie. He was at the entrance to the Second Guardhouse with his back to us. My commander and I went to the person and told him that his behavior was not right. My commander told him that he could go to the toilet at the gas station across the road and that it was not right to urinate against the wall. Polat K. also apologized to both of us. Then we went with the commander to the Central District Gendarmerie Command and took action against the person. After giving the necessary information to the on-duty prosecutor of the court, we received a call and came to the Aksaray Police Headquarters to take the necessary measures against Polat K. “That’s all I want to say about this incident,” he said.
“I warned him and he apologised.”
In a statement to police, the police chief on duty, Ramazan G., said: “On the day of the incident, I was working as a personnel affairs NCO at the Aksaray Provincial Gendarmerie Command. On the day of the incident, I saw Polat K. urinating against the wall of the command post with his back to me. I went to him and warned him that what he was doing was wrong. He also apologized to me. We then went to the Central Command to take formal action against him. “After reporting it to the prosecutor on duty, I came to the police station to file a complaint,” he said.
“There is a photo in the evidence file of the urine on the wall.”
Police added as evidence to the file photos of the wall at the crime scene and a photo showing that the wall was wet with urine, before sending the documents to the Aksaray Chief Prosecutor’s Office.
Polat K., who was investigated for the urination allegations, was charged by the Criminal Court of First Instance with “damage to public property” under Article 152-1-a of the Turkish Penal Code, which carries a maximum sentence of three years in prison.
In addition to punishing the defendants, the indictment sought to deprive them of the exercise of certain rights (the right to vote and the right to be elected) under Article 53(1) of the Turkish Penal Code.
It is demanded on behalf of the people that he be brought to justice and punished.
It is noteworthy that the indictment’s evidence headings were updated to include the following statements: suspect confessions, interrogation reports, witness statements, criminal history records, civil registration records, and full file coverage. The indictment read:
– Based on the suspect’s confession and witness testimony, it is clear that Polat K., whose clear identity is written above, committed the crime of vandalism by urinating on the wall of the Gendarmerie building and defacing public property. On the day of the incident, the Aksaray City Center Command, on behalf of the people, requests that the suspect be tried and punished in accordance with the specified terms of reference and that the safety measures provided for in Article 53 of the Turkish Penal Code be taken. The code will be applied to the suspect. The trial of the defendant will begin after the adjournment.
